Wildflower Health Privacy Policy

Protecting your private information is a priority for Wildflower Health, Inc. (“Wildflower Health,” “us” or “we”). This Privacy Policy applies to Due Date Plus and other online properties operated by us (“Due Date Plus”). This policy governs data collection and usage. By using Due Date Plus or accessing the Due Date Plus family of mobile applications, or the websites duedateplus.com, www.wildflowerhealth.com and any related sub-domains, you acknowledge and agree to the terms of this Privacy Policy and consent to the data collection and use practices described in this statement. Please read this policy in combination with our Due Date Plus Terms of Use.

Wildflower Health is not responsible for the privacy statements, policies, practices or other content on websites outside of the Wildflower Health applications or websites. We encourage you to review the privacy statements of websites you choose to link to from Wildflower Health so that you can understand how those websites collect, use and share your information. 

Collection of your Personal Information

When registering with Due Date Plus, we may ask you to provide us with your name, date of birth, and health plan membership information in order to verify your eligibility for the program using membership entitlement information received from your healthcare provider, Bupa Global. You may optionally enter your email address, health data and other information in order to fully use Due Date Plus. If you choose not to provide the requested information you may not be able to use and receive certain benefits, features or functions of Due Date Plus. Whenever you engage with our Service Platform, Wildflower Health also automatically receives and records information on our server logs from your browser, including your IP address, cookie information, and the pages you request, and relates it to the personal information you provide. We may request additional personal information or gather additional non-personal information in the future. 

Use of your Personal Information

Wildflower Health may share data with trusted partners that we engage to perform business functions and services on our behalf. Such functions may include, for example, database management and other technology services, hosting, statistical analysis, managing and warehousing historical data and providing legal, accounting or marketing services (such as email or postal mail) or customer support. All such third parties are contractually prohibited from using your personal information except to provide these services to Wildflower Health, and they are contractually required to maintain the confidentiality of your information..

Wildflower Health may keep track of the screens, views, and actions that our users take when they use Due Date Plus or visit our websites, in order to determine what Wildflower Health services are the most popular. This data is used to deliver customized content within Wildflower Health to customers whose behavior indicates that they are interested in a particular subject area.

Wildflower Health may disclose your personal information, without notice, to the extent necessary or appropriate to government agencies, advisors and other third parties in order to comply with applicable laws, the service of legal process, or if we reasonably believe such action is necessary to: (a) respond to a court order or request from a federal or state regulatory authority or to comply with any law or regulation requiring such disclosure; (b) protect and defend the rights or property of Wildflower Health; (c) prevent or aid in the investigation of a crime or protect national security; or (d) act under exigent circumstances to protect the personal safety of users of Wildflower Health, or the public.

We may also disclose your personal information in connection with an audit of our books and records, a merger, reorganization, dissolution, liquidation, or sale of some or all of our assets, stock or business.

Wildflower Health does not sell, rent or lease its customer lists to third parties.

Wildflower Health will provide regular reports about your use of the app and any health issues you disclose to ‘Bupa Global’, your healthcare provider, a trading name of Bupa Insurance Services Limited, incorporated in England and Wales whose registered office is at 1 Angel Court, LONDON, EC2R 7HJ. The information will enable Bupa Global to understand how its members use the app and whether the use of the app enables improved health outcomes or more efficient management of treatment options. The personal information received by Bupa Global will be handled at all times in accordance with their privacy and information security policies.

Security of your Personal Information

Wildflower Health secures your personal information from unauthorized access, use or disclosure through physical, administrative and reasonable technological measures. Although we will use reasonable efforts to safeguard the privacy of your personal information, transmissions over the Internet cannot be made absolutely secure. Wildflower Health assumes no responsibility or liability for disclosure of any of your personal information due to errors in transmission, unauthorized third-party access or other causes beyond our reasonable control. 

Use of Protected Health Information

We may create, collect, receive, maintain or transmit information between you and us, or between us and our clients, that is considered protected health information as defined under the Health Insurance Portability and Accountability Act of 1996 as amended from time to time including Sections 13400 through 13424 of the Health Information Technology for Economic Clinical Health Act (the “HITECH Act”) and the corresponding Standards for Privacy of Individually Identifiable Health Information (the “Privacy Rule”), Security Standards (the “Security Rule”) and Notification in Case of Breach of Unsecured Protected Health Information (the “Breach Notification Rule”) (collectively, (“HIPAA”). HIPAA defines such information as “PHI”. When we create, collect, receive, maintain or transmit PHI we do so under “business associate” agreements with our “covered entity” clients that require us to comply with HIPAA in doing so. For example, we may contract with health plans to deliver Due Date Plus to you and are considered to be a “business associate” of the “covered entity” health plan, as defined under HIPAA. We may share PHI with your health plan for plan administration purposes and/or coordination of your care as permitted under HIPAA.

We may aggregate de-identified PHI to help us understand the preferences and experiences of groups of our users for the benefit of our clients. 

Use of Cookies

Wildflower Health may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you personalize a web page, or navigate within a site, a cookie helps the site to recall your specific information on subsequent visits.

You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of the Wildflower Health services or websites you visit. 

Use of Beacons or GIF Files

Wildflower Health’s websites or mobile sites may contain electronic images know as web beacons – sometimes also called single-pixel gifs – that allow us to count user who have visited Due Date Plus or website and to deliver services. We may also include web beacons in promotional email messages or newsletters in order to determine whether messages have been opened and acted upon.

Children Under Thirteen

No person under 13 years old is permitted to use the Service Platform. Wildflower Health does not direct Due Date Plus to children under the age of 13 years or knowingly collect personal information from children under 13. If we become aware that a user under the age of 13 as registered or is attempting to register, we will notify the user that the user is not eligible for registration. We will then expunge any related personal information from our records. 

Modification, Opt-Out & Unsubscribe

You have the right, at any time, to review and/or modify any of your personal information that you provided during registration, or any other voluntarily provided information. We respect your privacy and give you an opportunity to opt-out of receiving announcements of certain information. Users may opt-out of receiving any or all communications from Wildflower Health by contacting us at team@wildflowerhealth.com. To protect your confidentiality, we can only send a requested profile to the email address listed in the profile. In any event, our back-up files will maintain copies of your personal information. We reserve the right to contact former users from time to time.

Changes to this Policy

Wildflower Health will occasionally update this Privacy Policy to reflect company and customer feedback, changes in the law, or other updates. Wildflower Health encourages you to periodically review this Privacy Policy to be informed of how Wildflower Health is protecting your information. Your continued access of Due Date Plus or our website constitutes your agreement to this Privacy Policy and any updates or revisions. 

Residents of European Union

The information collected by Wildflower Health or its affiliates on Due Date Plus may constitute “personal data” under the terms of the European Union Data Privacy Directive and the laws of the EU’s member states (collectively, “EU Law”). We may “process” your personal data, as that term is understood under EU Law, and may transfer your personal data to countries that are not considered by the European Union and/or its member states to maintain adequate levels of protection for personal data. By registering on and accessing Due Date Plus, you explicitly and unambiguously agree that (i) we may process and transfer your personal data as described above; and (ii) your personal data includes any additional information that you post, enter or upload to the System Platform.

California Privacy Act

California Civil Code Section 1798.83 permits customers of Wildflower Health, Inc. who are California residents to request certain information regarding its disclosure of personally identifiable information to third parties for their direct marketing purposes. Wildflower Health does not serve advertising on Due Date Plus or its affiliated websites.
